Introduction and acceptance

These Terms of Use ("Terms") govern your access to and use of the BOB website at backofficebuilders.com.au and the BOB software platform at app.backofficebuilders.com.au (together, the "Service"). References to "we", "us", or "BOB" mean the operator above.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
If you are using BOB on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms, and references to "you" include that entity.
Who these terms apply to
These Terms apply to all users of the Service, including:
- Visitors who browse the BOB marketing website
- Individuals and businesses who register for and use the BOB platform
- Team members who are invited to join an account by an account holder
BOB is intended for use by businesses and professionals. It is not designed for personal or consumer use. By using the Service, you confirm that you are using it for business purposes.
Use of the website and platform
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any way that:
- Violates any applicable law or regulation
- Infringes the rights of any other person or organisation
- Is fraudulent, deceptive, or misleading
- Introduces malware, viruses, or other harmful code
- Attempts to gain unauthorised access to any part of the Service or its underlying systems
- Disrupts or interferes with the security, integrity, or availability of the Service
Account responsibilities
When you create an account, you are responsible for:
- Providing accurate and up-to-date information when registering
- Keeping your login credentials secure and not sharing them with others
- All activity that occurs under your account
- Notifying us promptly if you become aware of any unauthorised access to your account
The person who creates an account is the account holder. Account holders are responsible for managing team member access within their account, including inviting, managing, and removing team members.
We are not liable for any loss or damage arising from your failure to keep your account credentials secure.
Acceptable use
You may use BOB to manage your business's quoting, project management, team coordination, and financial tracking. You agree not to use the Service to store, transmit, or process any content that is:
- Unlawful, harmful, or offensive
- In violation of any third party's intellectual property or privacy rights
- Subject to export restrictions or sanctions laws
We reserve the right to investigate suspected violations and take appropriate action, including suspending or terminating access to the Service.
Intellectual property
Our intellectual property
The Service, including its content, branding, design, software, and other materials, is owned by or licensed to the operator of BOB and is protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership of or licence to our intellectual property beyond the limited right to use the Service as described here.
Your data
You retain ownership of all data, content, and information you upload or create within the Service ("Your Data"). By using the Service, you grant us a limited licence to store, process, and display Your Data solely for the purpose of providing the Service to you.
We do not claim ownership of Your Data and will not use it for any purpose other than operating and improving the Service.
You are responsible for Your Data, including ensuring that it is accurate, lawful, and that you have all rights, consents and permissions necessary for us to process it in connection with the Service. You must not upload data that infringes another person's rights or breaches any law.
Fees and billing
BOB is offered on a subscription basis. Current pricing is published on our Pricing page.
By subscribing, you authorise us to charge the applicable subscription fee to your nominated payment method on a recurring monthly basis. All prices are in Australian dollars unless otherwise stated.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not provide refunds for unused portions of a billing period unless required by law.
We may change our pricing from time to time by giving you reasonable prior notice. If you do not agree to a price change, you may cancel your subscription before the new pricing takes effect.
Service availability and changes
We aim to keep BOB available and running reliably, but we do not guarantee uninterrupted access. The Service may be unavailable from time to time due to maintenance, updates, or circumstances outside our control.
We may update, modify, or discontinue features of the Service at any time. Where changes are material, we will endeavour to give reasonable notice. We are not liable for any loss or inconvenience caused by changes to or interruptions of the Service.
Free trial
We may offer a free trial period. During a free trial, you have access to the Service at no charge. At the end of the trial period, continued use of the Service requires a paid subscription.
We reserve the right to modify or end free trial offers at any time.
Third-party services
The Service uses third-party providers including Supabase (infrastructure), Stripe (payments), and Vercel (hosting). Your use of the Service is also subject to the terms and policies of those providers where relevant.
The Service or our website may contain links to third-party websites or resources. These links are provided for convenience only. We do not control, endorse, or accept responsibility for third-party content, products, or services.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, except as required by law.
BOB is a job management tool. It does not provide legal, financial, accounting, or professional advice. Any financial figures, quotes, or estimates generated using BOB are your responsibility to review and verify before relying on them.
To the fullest extent permitted by law, we exclude liability for any indirect, incidental, or consequential loss arising from your use of the Service.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or condition, that you have under the Australian Consumer Law that cannot lawfully be excluded or limited.
Suspension and termination
We may suspend or terminate your access to the Service if:
- You breach these Terms
- You fail to pay applicable fees
- We reasonably believe your account is being used unlawfully or in a way that harms other users or the platform
Where possible, we will give you notice before suspension or termination and an opportunity to remedy the issue.
You may close your account at any time by contacting us at hello@backofficebuilders.com.au.
After account closure, we may retain Your Data for up to 30 days to allow account recovery or administrative processing, after which we will delete or de-identify it unless we are required to retain it for legal, security, backup, fraud prevention, or dispute resolution purposes.
Governing law
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for any disputes arising under these Terms.
Changes to these terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will give reasonable notice — for example, by email or an in-app notification — before the changes take effect.
Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
